1. About these terms
These Terms of Service govern your use of PhotoAgent, an AI photo generation and editing service. PhotoAgent is currently operated as an independent online project rather than through a separately incorporated company. By using the service, you agree to these terms and our Privacy Policy and Cookie Policy.
2. Eligibility and accounts
You must be able to legally enter into these terms. The service is not directed to children under 13, and you must meet the minimum age required by the laws where you live. You are responsible for keeping your account credentials secure and for activity carried out through your account.
3. Your content
You must own or have permission to submit every prompt, image, reference file, name, likeness, trademark, and other material you provide. You retain your rights in your submitted content. You grant PhotoAgent a limited, worldwide, non-exclusive licence to host, copy, process, transmit, and display that content only as needed to operate, secure, troubleshoot, and improve the service. PhotoAgent does not use your prompts or images to train general-purpose AI models.
4. Generated content
AI output may be similar to content created for other users, may contain errors, and may not be suitable for every purpose. Rights in generated images are determined by applicable law and the terms of the model or provider used to create them. You are responsible for checking that your use of an output does not infringe another person’s rights. PhotoAgent does not promise that any output is exclusive, protectable, or available for a particular commercial use.
5. Credits, subscriptions, and refunds
Some features consume credits. Subscription plans renew automatically at the interval shown at checkout until cancelled. You can cancel an active subscription from your dashboard; cancellation normally applies to future renewals and does not retroactively restore credits. Credits already consumed by a successful generation are not refundable, except where a refund is required by applicable law or expressly provided by the checkout terms. Failed eligible generations may be refunded according to the product flow. Payments are processed by Stripe and may also be subject to Stripe’s terms.
6. Acceptable use
You may not use the service to break the law, infringe rights, create sexual content involving minors, facilitate abuse or fraud, impersonate others, bypass security or usage limits, upload malware, send abusive automated traffic, or generate content that unlawfully targets or harms another person. We may restrict or suspend access when reasonably necessary to protect users, the service, or third parties.
7. Availability and changes
Features may change, be limited, or be discontinued, including preview features. We do not guarantee uninterrupted availability or that generated content will always be preserved. We may update these terms by posting a revised version and changing the date above.
8. Disclaimers and liability
The service is provided on an “as available” basis. To the extent permitted by law, PhotoAgent disclaims warranties not expressly stated in these terms and is not responsible for indirect, incidental, special, consequential, or lost-profit damages. Nothing in these terms limits liability that cannot legally be limited or removes rights that consumers cannot waive.
9. Governing law and contact
These terms are intended to apply internationally. Mandatory consumer protections in the country where you live continue to apply. If a dispute cannot be resolved informally, it may be brought before a court with jurisdiction over the service operator or over you, as required by applicable law.
